USA 2026: Latest Study, Work & Residency Updates

The USA still hosts the world's largest share of international students, with unmatched universities and the well-known OPT → H-1B → green-card pathway. But 2026 has brought some of the most significant changes in decades, and several rules remain in flux. Here's a quick, useful — and honest — roundup for Indian students.

Work After Studies

  • After graduation, F-1 students can use Optional Practical Training (OPT) — up to 12 months of work in their field — and STEM graduates can add a 24-month STEM OPT extension, for up to three years total and three chances at the H-1B lottery.

  • The main long-term work route is the H-1B (specialty occupation, employer-sponsored, lottery-based, valid 3 years and renewable to 6).

  • Major 2026 change: a Presidential Proclamation introduced a $100,000 fee on new H-1B petitions filed on or after 21 September 2025 — currently being litigated but, per the latest guidance, still in effect. This is a significant new factor for graduates and employers to plan around.

Study in the USA

  • Students need an F-1 visa, issued against an I-20 from a SEVP-certified school and tracked in SEVIS. Traditionally, F-1 students were admitted for "Duration of Status" (no fixed end date).

  • Major 2026 change (proposed): DHS has moved to end Duration of Status and replace it with a fixed admission period capped at four years, potentially taking effect as early as September 2026. Programs running longer would need a USCIS Extension of Stay, and the post-study grace period may drop from 60 days to 30 days. These rules are not yet final and may face legal challenge, so current law applies until then.

  • Expect tighter screening — including expanded social-media vetting for F, J and H visa applicants (from 15 December 2025) — and higher fees, with the OPT application (Form I-765) now costing $1,780.
